Looking for a Will Lawyer?
You’ve come to the right place.

Avital Horef is a qualified attorney specializing in inheritance law.

One of the most sensitive legal issues is wills and inheritances. When a person dies leaving a will, or when they die without leaving a will, there are important bureaucratic procedures that the heirs must go through before reaching the stage of distributing the estate (property, assets, and money) among the legal heirs.

Because the death of a loved one is also an emotional matter, it is important that wills and inheritance matters be resolved quickly and efficiently, and in some cases through mediation, in order to preserve healthy relationships between the heirs.

When Can an Objection to a Probate Order Be Filed?

After an application for a probate order has been filed, the Registrar of Inheritance Affairs must publish a notice in a daily newspaper and in the official records, so that anyone with an interest in objecting to the will is aware of the application and can file an objection.

The objection to the probate order must be filed within 14 days from the date the notice is published, and as long as the order has not yet been issued (Section 67 of the Inheritance Law). Filing the objection is subject to a fee (NIS 968, as of 2022).

How Do You File an Objection to a Probate Order?

To file an objection to a probate order, the objection must be submitted together with all of the following accompanying documents: an application-opening form, an affidavit signed by the objector and verified by an attorney, a power of attorney (if the objector is represented by an attorney), and a receipt for payment of the fee.

Today, the objection and accompanying documents can easily be submitted online through the Registrar of Inheritance Affairs’ online system. Alternatively, they can be delivered to the Registrar physically through the public reception desks at the Registrar’s offices or by mail.
