Child Support in Joint Custody
Parents may reach an agreement regarding child support in a joint-custody arrangement and the amount to be paid for the child. The agreement may form part of a divorce or separation agreement, including arrangements between separated parents, co-parents, or parents who have a child outside a marital relationship. The agreement is submitted to the Family Court. If the agreement does not take the child’s best interests into account and the court merely approves it formally without holding a substantive hearing regarding child support, the child may later bring a support claim against both parents or either parent through an adult representative. Parents can also reach a mutual agreement and regulate child support in a joint-custody arrangement through an appropriate division of expenses and by signing the agreement before an attorney or the Family Court, thereby protecting and exercising their rights.
When parents share custody equally and child-support payments are required, both parents should have equal or reasonably comparable incomes and contribute according to their financial ability. For example, one parent may cover rent, clothing, and food while the other covers activities, workshops, daycare, school, and other ongoing expenses. In practice, the parents may transfer funds between them to cover the expenses, with one parent designated to manage the payments, so that both parents share the financial responsibility. The Family Court determines which parent will be responsible for managing the arrangement.
When child-support payments are required in a joint-custody arrangement, the Family Court sets the arrangement after examining the circumstances and the income of both parents. The decision on child support and on the amount to be paid is made with the child’s rights and best interests in mind, and not only the interests of the parents. If the parents cannot agree on the amount, a child-support claim may be filed and the court will determine the appropriate sum.
Under a Supreme Court ruling, the father (where the father is Jewish) carries full responsibility for child support until the child reaches the age of six. From the age of six onward, both parents share responsibility for child support in a joint-custody arrangement, and the burden is divided equally between them, in accordance with the ruling of the Family Court.
