Child Custody in Divorce
It is important to understand that child custody in divorce is determined in each case according to the specific circumstances. The main factors considered include the children’s needs and best interests, the children’s ages, the parents’ incomes, and their parenting abilities. Today, many fathers also want to remain extensively involved in their children’s lives after divorce, and an increasing number seek child custody arrangements.
When child custody in a divorce is awarded to the mother, the father is required to pay the children’s support in full. When custody is shared, however, the parents share custody of the children, and the related expenses are divided accordingly. Case law concerning child custody is dynamic and changes over time. The Supreme Court has also recently established a new rule stating that, in principle, when custody is shared, both parents bear the obligation to provide child support.
The statutory minimum for child support in divorce custody cases is currently in the range of slightly less than NIS 1,500 per child. This amount was established by the legislature as an amount intended to cover the basic needs of an individual child.
If the mother seeks a higher amount as part of a child-support claim, she must demonstrate the need for it. The claim requires the mother to present information regarding the financial capacity of her former spouse and herself, as well as the expenses required for the children, such as clothing and footwear, education, healthcare, food, and other needs.
Determining child custody and the amount of child support is a judicial decision. It might appear difficult to change such a decision because of the principle of finality of proceedings, which generally means that a matter already decided should not be litigated again. However, because child custody and child support concern the welfare of minors, the law permits these issues to be reconsidered when necessary for the child’s best interests and well-being. This applies whether the court made the determination or the parties agreed to it.
